Terms & Conditions

Last updated: 28 October 2026

Welcome to BitLayer. These Terms and Conditions (“Terms”) govern your use of this website and the IT services provided by Rahul Rameshchandra Parkale trading as BitLayer (ABN 87 554 983 542), a sole trader in Victoria, Australia. By accessing our website, requesting a quote or engaging our services, you agree to these Terms. If a written quote or agreement we both accept conflicts with these Terms, that quote or agreement applies. Our café loyalty service is covered by its own Café Loyalty Terms.

1. Services and projects

We provide online IT consulting, setup and project-based services as described on our website or in a specific project quote. Any change or addition requested after a project begins will be quoted and billed separately.

2. Project sign-off and post-project support

  • Project sign-off: when a one-off project is complete, you have 7 days to test and review the work. If no defects are reported in writing within that period, the project is treated as completed and accepted. Acceptance does not affect your rights under the Australian Consumer Law.
  • Post-project support: any IT support, troubleshooting, updates or maintenance requested after acceptance is post-project support. It is quoted and billed separately based on scope, or provided under a separate support agreement. This does not include fixing defects in our work or any failure to meet a consumer guarantee, which we will remedy at no charge as required by the Australian Consumer Law.
  • No ongoing maintenance: unless agreed in writing, a one-off project does not include ongoing monitoring, security patching or system maintenance.

3. Payment terms

Invoices are issued in Australian dollars (AUD). GST is not charged, as BitLayer is not registered for GST. One-off projects may require a deposit upfront, with the balance due within 7 days of acceptance (your written acceptance, or the end of the 7-day review period with no defects reported). If payment is late, we may suspend follow-up support or services until it is received. If you cancel a project before completion, you pay for work done up to that point, and any unused part of a deposit is refunded.

4. Intellectual property

Unless otherwise agreed in writing, all intellectual property rights in the code, custom configurations, scripts and documentation we develop or use in providing the services remain ours. You are granted a non-exclusive, non-transferable licence to use these materials solely for your internal business operations. Your own data and materials remain yours.

5. Limitation of liability

  • Nothing in these Terms excludes, restricts or modifies any right or remedy, or any guarantee, that you have under the Australian Consumer Law or any other law that cannot lawfully be excluded.
  • Subject to that, we are not liable for any indirect, incidental or consequential loss, including loss of profits, data loss, system downtime, cyberattacks or business interruption, arising from the use of our services, configurations or website. This does not apply to loss caused by our negligence, wilful misconduct or breach of these Terms.
  • You are responsible for keeping independent, up-to-date backups of all your systems, data and software before we perform any work.
  • Where our services are not of a kind ordinarily acquired for personal, domestic or household use, our liability for a failure to comply with a consumer guarantee is limited, at our option, to supplying the services again or paying the cost of having them supplied again.
  • Subject to the points above, our total liability for any claim under these Terms is limited to the amount you paid for the specific project or support that gave rise to the claim.

6. Governing law

These Terms are governed by the laws of Victoria, Australia. Any disputes are subject to the non-exclusive jurisdiction of the courts of Victoria.
