Café Loyalty Terms
Last updated: 28 October 2026
These terms apply to the BitLayer café loyalty service, which lets a café offer its own loyalty card in Apple Wallet and Google Wallet. The service is provided by Rahul Rameshchandra Parkale trading as BitLayer (ABN 87 554 983 542), a sole trader in Victoria, Australia. Part A applies to cafés that use the service. Part B applies to customers who hold a café’s loyalty card. Our general Terms & Conditions apply to anything these terms do not cover, and these terms apply where the two differ.
Part A: Cafés using the service
1. The service
We provide a branded loyalty card for your café, a counter QR code for customers to join, a staff web app for adding and redeeming tokens, and reports and CSV export for the owner. We set the service up for your café, and we may improve or change features over time without reducing the core service you signed up for.
2. Free trial
Where we agree a free trial in writing, there is no charge during the trial period. Before the trial ends we will confirm the ongoing fee with you. We will not charge you unless you agree in writing to continue. If you don’t, the service ends when the trial ends, without the 30 days’ notice in Section 7, and the rest of Section 7 applies.
3. Fees and payment
Setup and monthly fees are as set out in your quote or written agreement. Invoices are issued in Australian dollars and are due within 7 days. GST is not charged, as BitLayer is not registered for GST. If an invoice is unpaid for more than 14 days after a reminder, we may pause staff access until it is paid. Customers’ cards and earned tokens are not deleted while access is paused.
4. Your responsibilities
- Set your program’s rules (for example, how many tokens earn a reward) and honour rewards customers have earned.
- Give each staff member their own login, keep logins private, and remove staff who leave.
- Send promotional emails only to customers who have ticked the marketing consent box, in line with the Spam Act 2003 (Cth). Promotional emails must identify your café and how to contact you, every promotional email includes an unsubscribe link, and unsubscribes take effect within 5 business days.
- Display the counter QR poster and the privacy information we provide, and pass any customer privacy requests to us promptly.
- If you end your program, give customers at least 30 days’ notice to redeem rewards they have earned.
5. Your customer data
Your customer list belongs to you. We hold and process it on your behalf only to run the service, as described in our Café Loyalty Privacy Notice. We do not sell it, share it with other cafés, or use it to market our own services to your customers. You can export it as CSV at any time.
6. Availability and support
We take reasonable care to keep the service running, secure and backed up, but we do not guarantee it will be uninterrupted. Apple Wallet and Google Wallet are run by Apple and Google, and we cannot control outages or changes on their side. Staff can always search for a customer by name, email or phone if a card cannot be scanned. Contact [email protected] for support. Fixing defects in our service is included in your fee.
7. Ending the service
Either of us can end the service with 30 days’ written notice. We can end it sooner if fees remain unpaid, or if the service is misused and the misuse continues 7 days after our written notice. You can end it sooner if we materially breach these terms and do not fix the breach within 14 days of your written notice. If we end the service other than for unpaid fees or misuse, we will refund any fees paid for the period after the end date. Before the end date, you can export your customer list. After the service ends, customers’ cards stop updating (cards already in customers’ wallets stay on their phones showing the last balance), and we delete or de-identify your customers’ personal information within 60 days, unless you ask us in writing to keep it longer or the law requires us to keep it.
8. Liability
Nothing in these terms excludes rights you have under the Australian Consumer Law that cannot be excluded. Subject to that, we are not liable for indirect or consequential loss, such as lost sales. Our total liability for any claim is limited to the greater of A$500 and the fees you paid for the service in the 12 months before the claim. Our liability for a failure to meet a consumer guarantee is limited, at our option, to supplying the service again or paying the cost of having it supplied again. These limits do not apply to loss caused by our wilful misconduct or breach of our privacy obligations.
Part B: Loyalty card holders
9. Your card
- Your loyalty card is offered by the café you joined, which sets the rewards and decides how many tokens you earn. BitLayer runs the card on the café’s behalf.
- The card is free. Tokens are added by café staff when you make an eligible purchase, and rewards are redeemed at that café.
- Tokens do not expire while the café runs its program. Tokens and rewards have no cash value and cannot be exchanged, sold or transferred.
- If you lose your phone, ask the café staff to resend your card link.
- If the café ends its program, it will give at least 30 days’ notice so you can redeem rewards you have earned.
- The café may change its rewards with notice, but will not reduce tokens you have already earned.
- The café may correct tokens added by mistake. Every change is recorded.
10. Emails
You will only get promotional emails if you ticked the marketing consent box, and you can unsubscribe at any time using the link in any email. We may also send emails needed to run your card, such as your card link or a reward confirmation.
11. Your privacy
See our Café Loyalty Privacy Notice for what we collect and how it is used.
Governing law
These terms are governed by the laws of Victoria, Australia, and the courts of Victoria have non-exclusive jurisdiction.
